1. Bezahlung
Die Bezahlung erfolgt in der Währung des jeweiligen Landes, am vierten des Monats, über den Betrag der Einnahmen des vorausgegangenen Monat, durch elektronische Überweisung.
BDS bezahlt Teilnehmer des Partnerprogrammes erst, sobald die durch den Partner verschafften Zusatzeinnahmen 50€ entsprechen oder übersteigen. Sollte dies nicht der Fall sein, werden die zusätzlichen Einnahmen in den nächsten Monat übertragen und mit den Neueinnahmen solange zusammengerechnet, bis dieses den Betrag von 50€ überschreitet. Sollten die durch den Partner verschafften Zusatzeinnahmen niemals und in keiner Weise 50€ entsprechen oder überschreiten, und dies für einen fortlaufenden Zeitraum von zwölf Monaten nach Aktivierung des Accounts, so verfällt der Ansprucht des Teilnehmers auf eine Auszahlung, und der Betrag wird BDS zugesprochen, um Ihren Verwaltungsaufwand zu decken.
2. Haftung
Für Schäden entstehend aus einer Downtime, falscher Anwendung, technischen Angelegenheiten oder Falschrepräsentation sind wir nicht verantwortlich.
3. Kündigung
Wir behalten uns die fristlose Kündigung jedes Accounts sowie die Verweigerung jeglicher Auszahlung vor, sollte der Teilnehmer illegale oder ungehörige Machenschaften ausüben. Dieses umfasst, aber ist nicht begrenzt auf: Geldbetrug, Newsgroup spamming sowie dem unaufgeforderten Zusenden von eMails. Für solche Machenschaften haben wir keinerlei Toleranz.
4. Indemnity
You agree to indemnify and hold BDS, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post to or transmit through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.
5. General Practices Regarding use and Storage
You acknowledge that BDS may establish general practices and limits concerning use of the Service. You acknowledge that BDS reserves the right to log off accounts that are inactive for an extended period of time. You further acknowledge that BDS reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.
6. Modifactions to Service
BDS reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that BDS shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
7. Disclaimer
BDS AND/OR ITS RESPECTIVE SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY OF THE INFORMATION CONTAINED IN THE DOCUMENTS AND RELATED GRAPHICS PUBLISHED ON THIS SERVER FOR ANY PURPOSE. ALL SUCH DOCUMENTS AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. BDS AND/OR ITS RESPECTIVE SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. 8. Venue
Any dispute arising from, or in connection with the Service shall be construed under the laws of The Netherlands.
